These Terms of Service (the "Terms") form a binding agreement between you and PRESERVE Health LLC ("PRESERVE™", "we", "us") and govern your access to and use of our website (the "Site"), our products, and our services. Please read these Terms carefully — by using the Site or placing an order you agree to be bound by them.
Important: Sections 11 (Mandatory Arbitration) and 12 (Class Action Waiver) require disputes to be resolved by individual binding arbitration unless you opt out as described.
1. Eligibility
You must be at least 18 years old to use the Site or place an order.
2. The product — Important medical & supplement notice
PRESERVE™ Daily Creatine Gummies is a dietary supplement. It is not a drug. The product is intended for adults 18+ who wish to support healthy muscle function as part of a balanced diet and lifestyle.
These statements have not been evaluated by the Food and Drug Administration. PRESERVE™ is not intended to diagnose, treat, cure, or prevent any disease. Individual results may vary.
PRESERVE™ does not contain GLP-1 or any GLP-1 receptor agonist. PRESERVE™ is not affiliated with, endorsed by, or sponsored by Novo Nordisk A/S, Eli Lilly & Co., or any other pharmaceutical manufacturer. Ozempic®, Wegovy®, Mounjaro®, and Zepbound® are registered trademarks of their respective owners.
You should consult a qualified healthcare provider before starting PRESERVE™ or any new supplement — especially if you take prescription medication, are pregnant or nursing, have a known medical condition, or are under 18.
3. Account
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at hello@preserve-glp1.com if your account is compromised.
4. Orders, pricing, and availability
All orders are subject to acceptance and product availability. We reserve the right to refuse, cancel, or limit any order. Prices are in U.S. dollars, exclude applicable taxes, and may change. The applicable price is the one displayed at checkout when you place the order.
5. Subscriptions, recurring charges & auto-renewal
By selecting a "Subscribe & Save", "3-Month Supply", or "6-Month Supply" option you authorize PRESERVE Health LLC (and our subscription processor) to automatically charge your saved payment method on the recurring billing schedule you selected, until you cancel. Specifically:
- Monthly subscriptions are billed every 30 days
- 3-Month subscriptions are billed every 90 days as a single charge for 3 months of product
- 6-Month subscriptions are billed every 180 days as a single charge for 6 months of product
- Pre-renewal reminder. Where required by law (e.g., California's ARL) you receive a reminder at least 3 days before any recurring charge ≥ $200
- Cancel anytime. You may pause, skip, modify, or cancel your subscription at any time from your account. Cancellation must occur before the next billing date
- Price changes are communicated with at least 30 days advance notice; you may cancel before they take effect
6. Shipping
We ship within the United States. Standard ground delivery typically takes 3–5 business days from dispatch. Title and risk of loss pass to you upon delivery to the carrier.
7. Returns & refunds
Our return and refund terms — including the 60-day money-back guarantee — are described in our Refund Policy, incorporated by reference.
8. Acceptable use
You agree not to use the Site or our products in any way that violates law, for commercial resale without consent, to impersonate anyone, or to disrupt the Site through harmful code or scraping.
9. Intellectual property
The Site and all content on it (PRESERVE™ branding, logos, text, photos, video, software) are the property of PRESERVE Health LLC or our licensors. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
10. Disclaimers & limitation of liability
THE SITE AND THE PRODUCTS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PRESERVE HEALTH LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT IS LIMITED TO THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
11. Mandatory binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or our products shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English in the U.S. state where you reside.
Right to opt out. You may opt out of this arbitration provision by sending written notice to hello@preserve-glp1.com within 30 days of first accepting these Terms.
12. Class action waiver
You and PRESERVE Health LLC agree that any dispute will be resolved on an individual basis only and not as a class, consolidated, or representative action.
13. Governing law & venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
14. Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, if we reasonably believe you have violated these Terms.
15. Changes to these Terms
We may update these Terms at any time. Material changes will be posted to the Site with an updated "Effective date" and communicated by email.
